Reptiles4sale.com may be referred to as “we,” “us,” "Reptiles4sale", "site" or any other first-person pronouns. We may refer to the customer, person, or entity as "you", "your", "customer, "customers", or "users". These Terms & Conditions apply to all visitors and members of Reptiles4sale. By accessing, using, viewing, reading, printing or downloading any material from us, or becoming a member of Reptiles4sale, you agree to be bound by these Terms & Conditions.

Reptiles4sale and any other services acquired by the customer under this Agreement (collectively the "Services" or "Service")is governed by the Electronic Signatures in Global and National Commerce Act (E-Sign Act).

If you do not agree to be bound by these Terms & Conditions, you MAY NOT use our site or services: you must exit the site immediately, you may not use or access our site. You may only use and access our services only in accordance with these Terms & Conditions and any applicable laws.

USE OF SERVICE

Each time you use or access Reptiles4sale, you agree to be bound by these Terms & Conditions, and as amended from time to time with or without notification. In addition, if you are using a particular service on or through Reptiles4sale, you will be subject to any rules or guidelines applicable to those services and they shall be incorporated by reference into these Terms & Conditions.

To access Reptiles4sale or any services it has to offer, you may be asked to provide certain registration details or other information. It is a condition of your use of our services that all information you provide will be correct, current, and complete. If we believe that the information you provide is not correct, current, or complete, we have the right to refuse you access to our services and to terminate or suspend your access at any time.

MEMBERSHIP & AGE RESTRICTIONS

Membership: User accounts and passwords may not be assigned, transferred, or sold to a third party. You agree that the owners of this Reptiles4sale, exclusively reserve the right and may, at any time and without notice and any liability to you, modify or discontinue this website and it's services or delete the data you provide, whether temporarily or permanently. Reptiles4sale shall have no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information.

Age Restrictions: Some of our content may have graphic images or words that are not suitable for everyone. By using our site you acknowledge that you are at least 13 years of age. If you are under the age of 13, you must exit our site immediately and may not use or access our services. Ages 13 to 17 must have a parent or legal guardian's permission to access or use the Reptiles4sale. You agree not to bypass any security and/or access features that we have installed. Additionally, we do not assume any responsibility or liability for any misrepresentations regarding a user's age.

Registration: When registering an account on Reptiles4sale, it's the responsibility of the person signing up (and checking the box that he or she read this document) to have the owner of the account read and agree to our Terms & Conditions, if a different person will be signing up for them. Users must also ensure that any secondary users granted access to the service have also read and agreed to these Terms & Conditions.

In addition, they're solely responsible for obtaining access to our site and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access our site and services.

During the registration process, you will have the option to create a unique username and password which you must provide in order to gain access to our site. We reserve the right to disallow the use of usernames that we, at our sole discretion, deem inappropriate. We also reserve the right to cancel any account of any member who uses their selected username in violation of these Terms & Conditions or in any way we, in our sole discretion, deem inappropriate.

Registration Agreement:

  • Your membership, the username and password are non-transferable and non-assignable.
  • You are solely responsible for maintaining the confidentiality of your username and password and are fully responsible for all activities that occur under your username and password. We will not release your password for security reasons.
  • Ensure that you exit from your account at the end of each session. You are liable and responsible for any unauthorized use of the site and or services. Unauthorized access to the Reptiles4sale and its services is illegal and a breach of this Agreement. You indemnify us against all activities conducted through your account.

USER RESTRICTIONS

Reptiles4sale will not condone any behavior that involves the following:

  • Impersonate Reptiles4sale staff.
  • Upload or promote pornographic content.
  • Upload or promote illegal content.
  • Upload or promote racist content.
  • Create, store or backup copies of our data/asset files.
  • Run a bot or artificial posting script.
  • Post images that are considered fake or copyrighted.
  • Attempt to use exploits against our website.
  • Redirect to another listing site without our permission.
  • Copy another ad's information.
  • Abuse our system.
  • Abuse our API system.
  • Abuse our commenting system.
  • Register more than one account using the same IP address.

You also agree that Reptiles4sale is not liable for damages that you may suffer. Reptiles4sale has absolutely no control over material sent over the Internet and excludes all liability of any kind for the publication by any user of inaccurate, misleading, offensive, threatening or obscene material, or material that is in breach of the US or other applicable law.

REPTILE FEEDER CATEGORIES

  • This section of our website is dedicated to listings of reptile feeders for sale or exchange.
  • All feeder listings are user-generated, and we do not endorse or guarantee the accuracy, quality, safety, or legality of any feeders listed here.

    We are not responsible for the health of your reptiles or any adverse effects that may occur due to the use of feeders listed on our website. It is crucial to consult with a veterinarian or an expert in reptile care to ensure that the feeders you choose are appropriate and safe for your reptiles. Your reptiles' health should be your top priority.

CUSTOMER SUPPORT

Customer support is provided during normal business hours 9AM - 5PM CST and are subject to change at any time with or without notice. Any user who abuses, degrades or threatens any Reptiles4sale staff will be removed permanently along with their premium or non-premium listing. Customer support provides support for issues related to our site or services, we do not provide support for issues that may arise with sellers or buyers.

SITE NOTIFICATIONS

By creating an account on Reptiles4sale, you grant us permission to send you notices, warnings, internal newsletters and website information to your email. You can unsubscribe from notices, warnings and internal newsletters at any time by updating your settings on the account page.

SITE MESSENGER NOTIFICATIONS

By posting a listing on Reptiles4sale, you grant other site members permission to send you notifications regarding your listing. ALL messages sent using the site messenger, messages are recorded and are subject to review. 

POSTING REPTILE ADS

By submitting content to Reptiles4sale you agree to the following:

  • You AGREE to grant to us a worldwide, royalty-free, perpetual, non-exclusive right and license (including any moral rights or other necessary rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate, and to create derivative works and compilations, in whole or in part. Such license will apply with respect to any form, media, technology known or later developed.
  • You AGREE Reptiles4sale staff will not post an ad on your behalf or modify it's data for you.
  • You AGREE that you  are solely responsible for your ad listing and it's contents. If you violate our Terms & Conditions, you and your ad listing are subject to removal, with or without notice.
  • You agree to maintain a valid email address. Failure to maintain an valid email address will result in you being banned from posting any ads.
  • You AGREE to make all posting in ENGLISH only.
  • You AGREE NOT TO use any words that contain Reptiles4sale in your ad's title or in it's description.
  • You AGREE NOT TO use or copy another listings information such as title or description. 
  • You AGREE NOT TO display or promote other repltile ad listing sites.
  • You AGREE NOT TO upload or promote pornographic content in your listing.
  • You AGREE NOT TO upload or promote illegal content in your listing.
  • You AGREE NOT TO upload or promote racist content in your listing.
  • You AGREE NOT TO use a bot or artificial posting script for your listing.
  • You AGREE NOT TO upload  images that are considered fake or copyrighted content in your listing.
  • You AGREE NOT TO impersonate any Reptiles4sale staff in your content.

USER POSTED AD LISTINGS

All ad listings, postings, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from Reptiles4sale, are the sole responsibility of the person from whom such Content originated. You understand and agree that Reptiles4sale does not control, and is not responsible for Content made available through the Reptiles4sale, and that by using Reptiles4sale, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. 

You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will Reptiles4sale be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via Reptiles4sale.

You acknowledge that Reptiles4sale does not pre-screen or approve Content, but that Reptiles4sale shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via Reptiles4sale, for violating our Terms & Conditions.

FEATURED AD LISTINGS

Anyone can add Featured time to their ad listing. When a user Features an ad listing, it's displayed on the front page of the site in the Featured listed area for Featured time duration. Once the Featured time expires, the ad will be added to the regular listing area.

*Adding Featured time to an ad does not guarantee it you will make a sell or trade.

When you purchase Featured ad time, you agree to the following:

  • We reserve the right to cancel services at any time, for any reason, with or without notice. We reserve the right to cancel services at any time, for any reason, with or without notice.
  • During checkout, your IP address is recorded for security purposes.
  • Featured time a NON REFUNDABLE intangible virtual "item" that is used to promote ad listings.
  • Filing a PayPal claim for any reason will result in a permanent suspension of your account and the removal of your listing(s), regardless of your Featured status.
  • All sales are final and non-reversible or refundable.
  • Your ad is instantly Featured once your payment is processed using PayPal's Braintree API.
  • Anyone who tries to commit PayPal fraud will be reported to local law enforcement. As of today, we have reported 71 fraudulent users, 58 have been caught and charged which resulted in multiple fines which exceeded their original purchase. 

AD REMOVALS

Reptiles4sale reserves the right to remove any ad listing on our site regardless of it's Featured status, with or without notice. Ads are subject to removal if it breaks any of our Terms & Conditions and by no means are these the sole reasons for removal. Each removal is subject to Staff determation.

PROMOTIONAL LINKS

From time to time, Reptiles4sale may provide promotions that range from:

  • Bonus Featured time listing.
  • Free reptile equipment, food, decorations, lighting or other reptile related products.
  • Discounts with our partners.

3RD PARTY LINKS

Some websites which are linked to us are owned and operated by third parties. Because we have no control over such websites and resources, you acknowledge and agree that we are not responsible or liable for the availability of such external websites or resources, and does not screen or endorse them, and is not responsible or liable for any content, advertising, services, products, or other materials on or available from such websites or resources.

You further acknowledge and agree that Reptiles4sale shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such third-party content, goods or services available on or through any such website or resource. If you decide to access any such third-party website, you do so entirely at your own risk and subject to any terms and conditions and privacy policies posted therein.

Links to external websites (including external websites that are framed by the Site) or inclusions of advertisements do not constitute an endorsement by us of such websites or the content, products, advertising or other materials presented on our servers, but are for user's convenience. All users do hereby agree to hold Reptiles4sale harmless from any and all damages and liability that may result from the use of links that may appear on our servers. We reserve the right to terminate any link or linking program at any time.

INDEMNITY

You agree to defend, indemnify, and hold harmless, Reptiles4sale and our officers, directors, shareholders, employees, independent contractors, telecommunication providers, and agents, from and against any and all claims, actions, loss, liabilities, expenses, costs, or demands, including without limitation legal and accounting fees, for all damages directly, indirectly, and/or consequentially resulting or allegedly resulting from your, or you under another person’s authority including without limitation to governmental agencies, use, misuse, or inability to use our services or any of the Materials contained therein, or your breach of any of these Terms & Conditions. We shall promptly notify You by electronic mail of any such claim or suit, and cooperate fully (at Your expense) in the defense of such claim or suit. We reserve the right to participate in the defense of such claim or defense at its own expense, and choose its own legal counsel, but are not obligated to do so.

WARRANTY OF DISCLAIMER

YOU UNDERSTAND AND AGREE THAT YOUR USE OF THIS WEBSITE AND ANY SERVICES OR CONTENT PROVIDED (THE SERVICE) IS MADE AVAILABLE AND PROVIDED TO YOU AT YOUR OWN RISK. IT IS PROVIDED TO YOU AS IS AND WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, IMPLIED OR EXPRESS, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY, IMPLIED OR EXPRESS, THAT ANY PART OF THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, TIMELY, SECURE, ACCURATE, RELIABLE, OF ANY QUALITY, NOR THAT ANY CONTENT IS SAFE IN ANY MANNER FOR DOWNLOAD. YOU UNDERSTAND AND AGREE THAT NEITHER US NOR ANY PARTICIPANT IN THE SERVICE PROVIDES PROFESSIONAL ADVICE OF ANY KIND AND THAT USE OF SUCH ADVICE OR ANY OTHER INFORMATION IS SOLELY AT YOUR OWN RISK AND WITHOUT OUR LIABILITY OF ANY KIND.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT REPTILES4SALE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INDICENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSS (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM OR ARISING OUT OF (I) THE USE OF OR THE INABILITY TO USE THE SERVICE, (II) THE COST TO OBTAIN SUBSTITUTE GOODS AND/OR SERVICES RESULTING FROM ANY TRANSACTION ENTERED INTO ON THROUGH THE SERVICE, (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA TRANSMISSIONS, (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, OR (V) ANY OTHER MATTER RELATING TO THE SERVICE.
